The following terms and conditions apply to all contracts, deliveries and other services. Deviating provisions shall not apply; we hereby expressly object to such. All subsidiary agreements require written confirmation on our part.

The range of products offered in the Schullin Wien Online Shop is an invitation to the customer to make an offer to Schullin Wien GmbH (hereinafter referred to as Schullin Wien) to purchase under the conditions stated in the Schullin Wien Online Shop. All prices stated are in Euro and include the statutory value added tax. The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. By clicking the "Send order" button, you place a binding order for the goods contained in the shopping basket. Confirmation of receipt of the order follows immediately after the order has been sent. We may accept your order by sending an order confirmation by e-mail or by delivering the goods within five days. Schullin Wien reserves the right in particular not to accept the offer if an item is not available, if you have unjustifiably failed to pay invoices due to previous deliveries, if your credit card check is not successfully completed or if there are other justified doubts about your creditworthiness. If Schullin Wien is unable to fulfill an order, Schullin Wien will inform you of this as soon as possible. Orders are only accepted in quantities customary for households.

Note: the goods shown on the website have been digitally photographed. There may be minor deviations between the depiction of the goods and reality; such deviations do not constitute a defect in the goods ordered.

We store your order details. If you would like a printout of your order, you have the option of printing out an "order confirmation". This will appear on your screen after you have sent the order to us by clicking the "Complete Order" button and your credit card details have been successfully checked. You will also receive the order confirmation with all the specified data by e-mail, which can also be printed out.

Standard shipping within Austria costs € 4.90 - within Germany € 5.90. From a shopping basket of € 100.00, delivery is free of shipping costs. For customers resident in all other EU countries, shipping costs € 9.90. In this case, delivery is free of shipping costs from a shopping basket of € 200.00.

For "orders free of shipping costs" (from € 100): if the value of the goods falls below € 100 due to the return, the usual shipping costs (€ 4.90 AT/€ 5.90 DE) will be retained.

Delivery is made by DHL Paket GmbH, Österreichische Post AG or FedEx.

The delivery time is 2 to 5 days from order. If delivered items have obvious material or manufacturing defects, including transport damage, please complain about such defects to us immediately. However, failure to make this complaint has no consequences for your legal claims.

You can choose to pay for the goods by instant bank transfer, credit card or Paypal.

If you pay by credit card, your account will be debited upon completion of the order.

Should you be in default of payment, Schullin Wien shall be entitled to charge reminder fees as well as interest on arrears in the legally permissible amount and, if applicable, additional processing costs.

Schullin Wien reserves the right to allow only certain types of payment in the event of a negative result of the address and creditworthiness check.

We have an SSL connection (Secure Socket Layer) through which payment is processed.

Once the invoice amount has been reserved on your credit card account, we will process your order within the delivery period.

The goods shall remain the property of Schullin Wien GmbH until payment has been made in full.

For our customers who are consumers, the special provisions of the Consumer Protection Act ( KSchG ) apply. In particular, according to § 5e KSchG, consumers are entitled to withdraw from contracts concluded with us via our website within a period of 14 days, unless one of the exceptions to the right of withdrawal according to § 5f KSchG applies. The currently valid version of the KSchG can be found at www.ris.gv.at. It is sufficient if the declaration of withdrawal is sent within the period. In the case of contracts for the delivery of goods, the withdrawal period begins on the day of receipt by the consumer. In the event of withdrawal, the purchase price shall be refunded in full or in part concurrently with the return of the goods received from the customer. If the goods are not returned to us in an unused and resalable condition and in the original packaging, compensation may be demanded.

Consequences of withdrawal
In the event of an effective withdrawal, the services received by both parties shall be returned and any benefits derived (e.g. interest) shall be surrendered. If you are unable to return the performance received in whole or in part or only in a deteriorated condition, you may be required to compensate us for the loss in value. This does not apply to the surrender of goods if the deterioration of the goods is exclusively due to their inspection - as would have been possible for you in a shop, for example. In addition, you can avoid the obligation to pay compensation for the value of a deterioration caused by the intended use of the item by not using the item as if it were your property and by refraining from doing anything that could impair its value. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your declaration of withdrawal or the item, for us with its receipt.

All personal data is treated confidentially and your interests worthy of protection are strictly considered in accordance with the legal requirements.

We save the text of the contract and send you the order data and our General Terms and Conditions by e-mail. You can view your past orders in our customer log-in area.

The data necessary for the business transaction will be stored and, if necessary, passed on to our affiliated companies or our service partners within the framework of the order processing.

We use the data you provide to fulfil and process your order.

When registering for the newsletter, your e-mail address will be used with your consent for our own advertising purposes until you unsubscribe from the newsletter. You can unsubscribe at any time.

If we make advance payments, we may obtain credit information based on mathematical-statistical procedures from SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden, Germany, in order to protect our legitimate interests. Your interests worthy of protection will be taken into account in accordance with the statutory provisions.

You have the right to information about your stored data and, if applicable, the right to correction or deletion of this data.

Insofar as the pages of Schullin Wien contain links to other pages on the Internet, Schullin Wien expressly declares that it has no influence whatsoever on the design and content of the linked pages. Schullin Wien therefore hereby expressly distances itself from all content of all linked third-party sites. This declaration applies to all displayed links and to all contents of the pages to which links lead.

All contracts and agreements between the customer and Schullin Wien shall be governed by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for any disputes shall be Vienna or the place of jurisdiction provided for by law.
