Mit Aufgabe Ihrer Bestellung erkennen Sie die nachfolgenden Allgemeinen Geschäftsbedingungen an.

Nachstehende Bedingungen gelten für alle Verträge, Lieferungen und sonstige Leistungen. Abweichende Vorschriften gelangen nicht zur Anwendung; wir widersprechen solchen hiermit ausdrücklich. Alle Nebenabreden bedürfen der schriftlichen Bestätigung unsererseits.

2. Bestellung

Die im Schullin Wien Online Shop angebotene Produktpalette ist eine Aufforderung an den Kunden, der Schullin Wien GmbH (nachfolgend Schullin Wien) gegenüber ein Angebot zum Kauf zu den im Schullin Wien Online Shop angegebenen Bedingungen abzugeben. Alle angegebenen Preise sind Euro-Beträge und verstehen sich inklusive der gesetzlichen Mehrwertsteuer. Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot, sondern einen unverbindlichen Online-Katalog dar. Durch Anklicken des Buttons “Bestellung senden” geben Sie eine verbindliche Bestellung der im Warenkorb enthaltenen Waren ab. Die Bestätigung des Eingangs der Bestellung folgt unmittelbar nach dem Absenden der Bestellung. Wir können Ihre Bestellung durch Versand einer Bestellbestätigung per E-Mail oder durch die Auslieferung der Ware innerhalb von fünf Tagen annehmen. Schullin Wien behält sich insbesondere vor, das Angebot nicht anzunehmen, wenn ein Artikel nicht verfügbar ist, wenn Sie Rechnungen aufgrund früherer Lieferungen unberechtigt nicht bezahlt haben, wenn Ihre Kreditkartenprüfung nicht erfolgreich abgeschlossen wird oder wenn sonst berechtigte Zweifel an Ihrer Bonität bestehen. Kann Schullin Wien eine Bestellung nicht ausführen, teilt Schullin Wien Ihnen dies schnellstmöglich mit. Bestellungen werden nur zu haushaltsüblichen Mengen angenommen.

Ein Hinweis: die auf der Website dargestellten Waren wurden digital fotografiert. Es kann zu geringfügigen Abweichungen zwischen der Darstellung der Ware und der Wirklichkeit kommen; solche Abweichungen stellen keinen Mangel der bestellten Ware dar.

Wir speichern Ihre Bestelldaten. Sofern Sie einen Ausdruck Ihrer Bestellung wünschen, haben Sie die Möglichkeit, eine “Bestellbestätigung” auszudrucken. Diese erscheint auf Ihrem Bildschirm, nachdem Sie die Bestellung durch das Betätigen des “Bestellung abschließen” Buttons an uns abgeschickt haben und Ihre Kreditkartendaten erfolgreich geprüft wurden. Zudem erhalten Sie die Bestellbestätigung mit allen angegebenen Daten per E-Mail, die ebenfalls ausgedruckt werden kann.

3. Lieferung und Versandkosten

Der Standard-Versand innerhalb Österreichs kostet € 4,90 – innerhalb Deutschlands € 5,90. Ab einem Warenkorb von € 100,00 erfolgt die Lieferung versandkostenfrei. Für Kunden, die in allen anderen Ländern der EU ansässig sind, kostet der Versand € 9,90. In diesem Fall erfolgt die Lieferung ab einem Warenkorb von € 200,00 versandkostenfrei.

Für „versandkostenfreie Bestellungen“ (ab € 100): falls der Warenwert durch die Rücksendung unter € 100 sinkt, werden die üblichen Versandkosten (€ 4,90 AT/€ 5,90 DE) einbehalten.

Die Lieferung erfolgt mit DHL Paket GmbH, der Österreichischen Post AG bzw. FedEx.

Die Lieferzeit beträgt 2 bis 5 Tage ab Bestellung. Sollten gelieferte Artikel offensichtliche Material- oder Herstellungsfehler aufweisen, wozu auch Transportschäden zählen, so reklamieren Sie bitte solche Fehler sofort gegenüber uns. Die Versäumung dieser Rüge hat allerdings für Ihre gesetzlichen Ansprüche keine Konsequenzen.

4. Bezahlung

Sie können die Waren wahlweise per Sofortüberweisung, Kreditkarte oder Paypal bezahlen.

Bei Zahlung per Kreditkarte erfolgt die Belastung Ihres Kontos mit Abschluss der Bestellung.

Sollten Sie mit der Bezahlung in Verzug geraten, ist Schullin Wien berechtigt, Mahngebühren sowie Verzugszinsen in gesetzlich zulässiger Höhe und gegebenenfalls zusätzlich anfallende Bearbeitungskosten zu verlangen.

Schullin Wien behält sich vor, bei negativem Ergebnis der Adress- und Bonitätsprüfung nur bestimmte Zahlarten zuzulassen.

Wir verfügen über eine SSL-Verbindung (Secure Socket Layer), über welche die Bezahlung abgewickelt wird

Nach erfolgter Reservierung des Rechnungsbetrags auf Ihrem Kreditkartenkonto, bearbeiten wir Ihre Bestellung innerhalb der Lieferfrist.

5. Eigentumsvorbehalt

Die Ware bleibt bis zur vollständigen Bezahlung Eigentum der Schullin Wien GmbH.

6. Rücktrittsrecht

Für unsere Kunden, die Verbraucher sind, gelten die Sonderbestimmungen des Konsumentenschutzgesetzes ( KSchG ). Insbesondere sind Verbraucher gemäß § 5e KSchG berechtigt, von den mit uns über unsere Website abgeschlossenen Verträgen unter Wahrung einer Frist von 14 Tagen zurückzutreten, sofern nicht eine der Ausnahmen vom Rücktrittsrecht gemäß § 5f KSchG Anwendung findet. Die jeweils gültige Fassung des KSchG können Sie unter www.ris.gv.at abrufen. Es genügt, wenn die Rücktrittserklärung innerhalb der Frist abgesendet wird. Die Rücktrittsfrist beginnt bei Verträgen über die Lieferung von Waren mit dem Tag ihres Einganges beim Verbraucher. Im Falle des Rücktritts findet eine gänzliche oder teilweise Rückerstattung des Kaufpreises Zug um Zug gegen Zurückstellung der vom Besteller erhaltenen Waren statt. Falls die Ware nicht im ungenützten und wiederverkaufsfähigen Zustand und in der Originalverpackung an uns rückgestellt wird, darf ein Wertersatz verlangt werden.

Rücktrittsfolgen

Im Falle eines wirksamen Rücktritts sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen (z. B. Zinsen) herauszugeben. Können Sie uns die empfangene Leistung ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren, müssen Sie uns insoweit ggf. Wertersatz leisten. Bei der Überlassung von Sachen gilt dies nicht, wenn die Verschlechterung der Sache ausschließlich auf deren Prüfung – wie sie Ihnen etwa im Ladengeschäft möglich gewesen wäre – zurückzuführen ist. Im Übrigen können Sie die Pflicht zum Wertersatz für eine durch die bestimmungsgemäße Ingebrauchnahme der Sache entstandene Verschlechterung vermeiden, indem Sie die Sache nicht wie Ihr Eigentum in Gebrauch nehmen und alles unterlassen, was deren Wert beeinträchtigt. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit der Absendung Ihrer Rücktrittserklärung oder der Sache, für uns mit deren Empfang.
